This website, medieval-sword.store (the "Site"), is operated by Fuji Corp Kft. Throughout the Site, the terms "Medieval Sword", "we", "us" and "our" refer to Fuji Corp Kft. We offer this Site, including all information, tools and services available from it, to you, the user, on the condition that you accept all the terms, conditions, policies and notices stated here.

By visiting the Site and/or purchasing from us, you use our "Service" and agree to be bound by these Terms of Service (the "Terms"), together with our Refund Policy and Shipping Policy, which form part of these Terms. Our Privacy Policy explains how we handle your personal information. These Terms apply to all users of the Site, including browsers, customers and contributors of content.

Please read these Terms carefully before using the Site or placing an order. If you do not agree with them, you may not use the Site or the Service. Nothing in these Terms limits the mandatory rights you have as a consumer under the law of your country of residence.

Our products are swords and bladed items intended for adults. By placing an order, you confirm that:

  • you are at least 18 years old, or the minimum legal age in your country or state if it is higher;
  • you are legally allowed to purchase, import and own the products you order at the delivery destination;
  • you will use, store and transport your products in compliance with all applicable laws, including laws on carrying bladed items in public.

We may ask for proof of age before shipping, and we may cancel any order with a full refund if we have reason to believe that the buyer or the recipient is under the legal age, or that the order would breach applicable laws. If you buy a sword as a gift, you are responsible for making sure the recipient is an adult legally allowed to own it.

Section 3: Use of the Online Store

You may not use our products or the Service for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including intellectual property laws) when using the Service. You must not transmit any worms, viruses or other code of a destructive nature. Any breach of these Terms may result in the immediate termination of your access to the Service.

Section 4: General Conditions

We reserve the right to refuse service to anyone, for any lawful reason, at any time. Your content (excluding payment card information) may be transferred unencrypted and involve transmissions over various networks and changes to meet the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service or access to the Service without our express written permission. Section headings are included for convenience only and do not affect the interpretation of these Terms.

Section 5: Orders and Contract Formation

To place an order, choose your product and its options (such as sharpening and engraving), add it to your cart, enter your delivery and payment details at checkout and confirm your order. Before confirming, you can review your order and correct any input errors.

After placing your order, you will receive an order confirmation by email. The contract of sale is concluded when we send this confirmation. The contract is concluded in English. We keep a record of your order, and a copy is sent to you by email and remains available in your customer account if you have one.

We may refuse or cancel an order, in particular in case of suspected fraud, a pricing or product information error, product unavailability or legal restrictions at the destination. In that case, you will be fully refunded. We may also limit the quantities purchased per person, per household or per order, and limit or refuse orders that, in our judgment, appear to be placed by dealers, resellers or distributors.

If you order an engraving, you are responsible for the accuracy of the text you provide (spelling, characters and spacing). Engravings are made exactly as entered at checkout.

Section 6: Prices and Payment

Prices are displayed in US dollars (USD), or in your local currency where this option is available. Unless otherwise stated at checkout, our prices include import duties and taxes for most destinations (see our Shipping Policy). Any tax or fee that must be added will be shown at checkout before you pay. Your bank may charge currency conversion fees.

Prices may change at any time without notice, but the price charged is the price shown at checkout when you place your order. We accept the payment methods displayed at checkout, such as Visa, Mastercard, American Express, Discover, Diners Club, JCB, Apple Pay and Google Pay. Payments are processed securely by our payment providers, and we never have access to your full card number.

Promotional codes cannot be combined unless otherwise stated and cannot be applied to previous purchases.

Section 7: Shipping, Returns and Guarantee

Shipping, delivery times, customs and delivery conditions are described in our Shipping Policy. Cancellations, returns, refunds, the statutory right of withdrawal for eligible consumers and our Lifetime Craftsmanship Guarantee are described in our Refund Policy.

Section 8: Products and Handmade Variations

Our swords are hand-forged and assembled by craftsmen. Each piece is therefore unique, and slight variations in dimensions, weight, finish, the grain of wood or leather, and engraving placement may occur compared with product photos and specifications. These variations are inherent to handmade products and are not defects.

We make every effort to display the colors and images of our products as accurately as possible, but we cannot guarantee that your screen displays colors accurately. Some products are available in limited quantities, and we may discontinue any product at any time.

Sharpened and unsharpened versions: sharpened (battle-ready) swords have a functional edge and are intended for display and cutting practice. Unsharpened versions are intended for HEMA drills and sparring with appropriate protective equipment. Never spar or practice partner drills with a sharpened sword.

Section 9: Safety and Responsible Use

Swords are heavy, sharp and potentially dangerous objects. By purchasing from us, you agree to:

  • handle your sword with care and use it only for lawful purposes, such as collecting, display, historical reenactment, martial arts practice and cutting practice;
  • keep it out of reach of children and store it securely;
  • never carry it in public unless permitted by law, and always transport it in a closed case or bag;
  • use appropriate training and protective equipment for any practice or sparring;
  • maintain your blade (cleaning and oiling) to prevent rust and deterioration.

To the extent permitted by law, we are not liable for any injury, damage or loss resulting from the misuse, improper handling, modification or unlawful use of our products.

Section 10: Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account information for all purchases made on the Site, and to promptly update your information (including your email address and payment details) so that we can complete your transactions and contact you when needed. If we modify or cancel an order, we may notify you using the email address, billing address or phone number provided at the time of the order.

Section 11: Accuracy of Information, Errors and Omissions

We work to keep the information on the Site accurate and up to date. However, it may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, transit times or availability. We reserve the right to correct any error, inaccuracy or omission, to change or update information, and to cancel orders if any information on the Site is inaccurate, at any time and without prior notice (including after you have submitted your order). If we cancel an order for this reason, you will be fully refunded.

Historical and educational content about swords is provided for general information only.

Section 12: Third-Party Tools and Links

We may give you access to third-party tools that we do not monitor or control. These tools are provided "as is" and "as available", without any warranty or endorsement from us, and your use of them is at your own risk and subject to the terms of their providers.

Links on the Site may lead to third-party websites that are not affiliated with us. We are not responsible for their content, products, services or practices. Please review their policies carefully before engaging in any transaction with them.

Section 13: Reviews, Comments and Other Submissions

If you send us reviews, photos, ideas, suggestions or other materials (together, "comments"), you grant us a non-exclusive, royalty-free, worldwide license to use, edit, copy, publish, translate and distribute them in any medium, including on the Site and in our advertising. We have no obligation to keep comments confidential, to pay any compensation for them or to respond to them.

You agree that your comments will not infringe any third-party rights (including copyright, trademark, privacy or personality rights), will not contain unlawful, abusive or obscene material or malware, and will not mislead anyone about their origin or your identity. We may, but are not obliged to, monitor, edit or remove content that we consider unlawful, offensive or otherwise objectionable.

Section 14: Personal Information

Your submission of personal information through the Site is governed by our Privacy Policy.

Section 15: Intellectual Property

All content on the Site, including texts, photographs, videos, graphics, logos and product descriptions, is owned by or licensed to us and protected by intellectual property laws. You may not reproduce or use it without our prior written permission.

Some of our swords are inspired by films, series, books or video games. These products are not official merchandise and are not affiliated with, endorsed or sponsored by the owners of those works. The names of such works are used for descriptive purposes only, and all related trademarks belong to their respective owners.

Section 16: Prohibited Uses

In addition to the other restrictions in these Terms, you may not use the Site or its content: (a) for any unlawful purpose or to encourage others to act unlawfully; (b) to violate any international, federal, national, state or local law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame or discriminate against anyone; (e) to submit false or misleading information; (f) to upload or transmit viruses or any other malicious code; (g) to collect or track the personal information of others; (h) to spam, phish, crawl or scrape the Site; (i) for any obscene or immoral purpose; or (j) to interfere with or circumvent the security features of the Site. We may terminate your use of the Service for violating any of these prohibitions.

Section 17: Disclaimer of Warranties and Limitation of Liability

We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, and we may suspend or discontinue the Service at any time.

Except as expressly stated by us (including in our Lifetime Craftsmanship Guarantee) and to the maximum extent permitted by law, the Service and the products delivered through it are provided "as is" and "as available", without any other express or implied warranty.

To the maximum extent permitted by law, Fuji Corp Kft and its directors, employees, affiliates, agents, contractors, suppliers, service providers and licensors shall not be liable for any indirect, incidental, punitive, special or consequential damages, including lost profits, lost revenue, lost savings or loss of data, arising from your use of the Service or of any product purchased through it. Our total liability for any claim relating to a product is limited to the price paid for that product.

Nothing in these Terms excludes or limits our liability where it cannot legally be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud, or under the mandatory consumer protection laws of your country of residence (including your statutory rights regarding defective or non-conforming products).

Section 18: Indemnification

You agree to indemnify, defend and hold harmless Fuji Corp Kft and its affiliates, partners, directors, employees, agents, contractors, licensors, service providers, subcontractors and suppliers from any claim or demand, including reasonable attorneys' fees, made by a third party due to or arising out of your breach of these Terms, your violation of any law or of the rights of a third party, or your misuse of a product purchased from us.

Section 19: Severability, Termination and Entire Agreement

If any provision of these Terms is found to be unlawful, void or unenforceable, it shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

These Terms remain in effect until terminated by you or by us. You may terminate them at any time by ceasing to use the Site. If you fail to comply with these Terms, we may terminate this agreement and deny you access to the Service without notice; you will remain liable for all amounts due up to the date of termination. Obligations and liabilities incurred before termination survive it.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms and the policies posted on the Site constitute the entire agreement between you and us regarding the Service and replace any prior agreements, communications or versions of these Terms.

Section 20: Governing Law and Dispute Resolution

These Terms and any contract of sale concluded through the Site are governed by the laws of Hungary, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

If you have a complaint, please contact us first at support@medieval-sword.store: most issues can be resolved quickly and amicably. Consumers in the European Union can also get free help with cross-border disputes from the European Consumer Centres Network (ECC-Net), or refer the dispute to the conciliation body competent for our registered office: the Budapest Conciliation Board (Budapesti Békéltető Testület), 1016 Budapest, Krisztina krt. 99, Hungary, bekelteto.testulet@bkik.hu, https://bekeltet.bkik.hu.

Subject to the mandatory rules protecting consumers, who may bring proceedings before the courts of their place of residence, any dispute that cannot be resolved amicably will be submitted to the competent courts of Budapest, Hungary.

Section 21: Changes to These Terms

You can review the most current version of these Terms at any time on this page. We may update, change or replace any part of these Terms by posting the new version on the Site. The version in force at the time you place an order applies to that order.
